What are the grounds for extending the period of stay in Ukraine
• applied for an immigration permit ;
• applied application for obtaining citizenship of Ukraine;
• there are reasons that do not give the opportunity to leave Ukraine;
• other circumstances (treatment , pregnancy , looking after a sick family member, registration of an inheritance, exercising the powers of a foreign correspondent or a representative of a foreign media ).

What documents are needed to extend the term
The application is submitted in person .
The documents :
• passport of a foreigner or a document certifying a stateless person (+copies of pages with personal data);
• translation into Ukrainian of the pages of the above documents, certified by a notary;
• a copy of the permanent or temporary residence permit, or other document that confirms the legality of stay on the territory of Ukraine;
• a document that confirms the availability of financial security to cover the costs associated with staying in Ukraine;
• 4 photos sized 3.5x4.5;
• receipt of payment of the state fee for the extension of stay or a document that confirms the availability of benefits regarding payment.

Under what conditions can an extension of stay be refused
• ensuring national security or protecting civil order;
• health protection , protection of the rights or legitimate interests of citizens of Ukraine ;
• when the passport document is fake, damaged or does not correspond to the established model, or belongs to another person ;
• submission of deliberately false information or forged documents;
• when the fact of non-compliance with the decision of the court or state authorities is revealed, or such persons have debt obligations ;
• when there are objective reasons to believe that a foreigner or stateless person has grounds and purposes of arrival in Ukraine other than those indicated in the application ;
• lack of sufficient financial support for the period of stay in Ukraine.

How long does it take to apply for an extension of stay
A foreigner or a stateless person submits an application for the extension of the period of stay on the territory of Ukraine not earlier than 10 and not later than 3 working days before the end of the period of legal stay, to the migration service. Відкрити / Коментувати

Каковы основания для продления срока пребывания в Украине
• подано заявление о получении разрешения на иммиграцию ;
• подано заявление о получении гражданства Украины;
• есть основания, которые не дают возможности выехать из Украины;
• другие обстоятельства (лечение , беременность , присмотр за больным членом семьи, оформление наследства, выполнение полномочий иностранного корреспондента или представителя иностранного СМИ ).

Какие нужны документы для продолжения срока
Заявление подаётся лично .
Документы :
• паспорт иностранца или документ, удостоверяющий личность лица без гражданства (+ копии страниц с личными данными);
• нотариально заверенный перевод на украинский язык страниц вышеупомянутых документов;
• копия вида на постоянное или временное проживание, или другого документа, который подтверждающего законность пребывания на территории Украины;
• документ, подтверждающий наличие финансового обеспечения для покрытия трат, связанных с пребыванием в Украине;
• 4 фото размером 3.5x4.5;
• квитанция об оплате государственной пошлины за продление срока пребывания или документ, подтверждающий наличие льгот касательно оплаты.

3. При каких условиях может быть отказано в продолжении срока пребывания
• обеспечение национальной безопасности или охрана гражданского порядка;
• охрана здоровья , защита прав или законных интересов граждан Украины ;
• если паспортный документ подделан, испорчен или не соответствует установленному образцу, принадлежим другому лицу ;
• подача заведомо неправдивой информации или поддельных документов;
• если выявлен факт невыполнения решения суда или органов государственной власти, или же такие лица имеют долговые обязательства ;
• если есть объективные причины считать, что иностранец или лицо без гражданства имеет иные, нежели указанные в заявлении, основания и цели прибытия в Украину ;
• отсутствие достаточного финансового обеспечения на период срока пребывания в Украине.

4. В какой срок нужно обратиться с заявлением о продлении срока пребывания

Иностранец или лицо без гражданства может находиться в Украине до тех пор, пока действует виза.

Что делать, если закончился срок пребывания
Если иностранец желает остаться в Украине и имеет для этого основания, то следует обратиться в миграционную службу за продлением срока пребывания. Если нет, то нужно покинуть территорию Украины в установленный законодательством срок.

Ответственность за нарушения срока пребывания иностранцев в Украине
За нарушения срока пребывания в Украине предусмотрена административная ответственность. Такая ответственность предполагает оплату штрафа . Также, законодательство Украины предусматривает, что иностранцы, которые нарушили срок пребывания, могут быть принудительно выдворены или возвращены в страну-происхождения или в третью страну. Стоит помнить, что принудительное возвращение может сопровождаться запретом на въезд в Украину .
Кроме того, к административной ответственности также могут быть привлечены лица, которые незаконно пересекли границу Украины или пытались это сделать.
Иностранцы или же лица без гражданства, которые незаконно пересекли границу с намерением получить международную защиту и немедленно подали заявление в миграционную службу , освобождаются от административной ответственности.

How to calculate such a period
A foreigner or stateless person can stay in Ukraine as long as the visa is valid.
For citizens from states with a visa-free entry to Ukraine , a period of no more than 90 days within 180 days is allowed, unless otherwise provided by international treaties of Ukraine.

What to do if the period of stay has ended
If a foreigner wishes to stay in Ukraine and has grounds for this, then you should contact the migration service for an extension of the period of stay. If not, then you need to leave the territory of Ukraine within the period established by law.

Responsibility for violations of the period of stay of foreigners in Ukraine
For violation of the period of stay in Ukraine, administrative liability is provided. This liability includes the payment of a fine . Also, the legislation of Ukraine provides that foreigners who have violated the period of stay may be forcibly expelled or returned to their country of origin or to a third country. It is worth remembering that forced return may be accompanied by a ban on entry into Ukraine .
In addition, persons who illegally crossed the border of Ukraine or tried to do so may also be held administratively liable.

What is the term for consideration of the case on appealing the entry ban

Usually, out-of-court dispute resolution takes up to 1 month. Litigation can take from several months or more , which is quite difficult to predict.

Куда можно обжаловать запрет на въезд

Запрет на въезд возможно обжаловать без обращения в суд . Если не удается обжаловать решение во внесудебном порядке, то можно обратится в суд общей юрисдикции в административном порядке.

Какой срок рассмотрения дела об обжаловании запрет на въезд

Обычно, внесудебное разрешение спора занимает до 1 месяца. Судебное разбирательство может занимать от нескольких месяцев и более , что довольно затруднительно прогнозировать.

Reasons for the ban on entry into Ukraine

An authorized state body can prohibit entry into Ukraine to a foreigner or stateless person in such circumstances:
1) in order to ensure national security;
2) to protect the health and rights of the people of Ukraine;
3) in case of submission of false data during passport control;
4) in case of providing a fake, damaged passport;
5) in case of violation of the rules for crossing the border of Ukraine;
6) in case of non-fulfillment of obligations during the previous stay in Ukraine;
7) in case of entry into the temporarily occupied territory of Ukraine outside the checkpoints.

Who makes the decision to ban entry

The decision to ban entry into Ukraine for a period of 3 years can be made by the Migration Service, the Border Guard Service, the Security Service of Ukraine. Other bodies, as well as legal entities and individuals, can initiate such a decision.

If you have been given a decision to ban entry to Ukraine, you need to :

1) Politely ask for a decision to refuse to cross the border, indicating the reason. DO NOT argue with border guards , violate the rules of staying at the checkpoint, otherwise you may be held administratively liable;
