The selection for the Willem C. Vis International Commercial Arbitration Moot has started.
The Vis Moot is the biggest and most prestigious moot in the sphere of international commercial law and arbitration. It takes place annually in Vienna at the end of spring. Usually, more than 300 teams from around the world take part in it. The problem typically arises from an international sales transaction governed by the United Nations Convention on Contracts for the International Sale of Goods (CISG) and involves both substantive (commercial law) and procedural (international arbitration) issues.
If you are:
• a highly-dedicated person with strong knowledge of English (at least upper-intermediate)
• interested in International Commercial Arbitration
• want to gain a life-changing experience and improve your legal writing and speaking skills
then send us your resume and a brief memorandum (no more than 2 pages) containing an analysis of the following situations:
Seller and buyer concluded an international sales contract, which included the following clause:
"Arbitration.
1. Any dispute arising in connection with the performance of this Contract shall be resolved by negotiations between the Parties.
2. If it is impossible to resolve such a dispute by negotiations, this Contract shall be governed by and construed in accordance with English law and the place of jurisdiction shall be London."
Question: What method of dispute resolution did the parties provide for in the contract? What should be the law governing any potential arbitration proceeding? Where would be the seat of arbitration?
Ukrainian retailer entered into a contract with a German manufacturer to buy 10 refrigerators and to repair 2 refrigerators. The parties provided for Ukrainian law as governing law of the contract.
Question: What law should the court apply in litigation to resolve the issues of (1) the manufacturer's failure to deliver the goods, and (2) the manufacturer's defense that the contract is substantively invalid?
